A recent judgment by an Illinois jury against a major
freight broker awarded $23.8 MILLION in damages for an accident involving one
of their carriers that killed two people and badly injured a third.
This incident, as well as a similar case that occurred in
2004, has set a precedent that has placed liability not only with the carrier
involved in a traffic incident, but also the shipper or broker.
Robert Digges, deputy chief counsel for American Trucking
Associations and an experienced litigator, was quoted as saying, “…there has
been a trend in recent years for plaintiffs to go after brokers on negligent
retention or entrustment grounds for allegedly contracting with a motor carrier
that has a poor safety record.” In other words, if you do not do everything you

The Transportation Intermediaries Association supposedly
would like to see the minimum for auto liability policies raised well above $1
