Required HazMat Training

 


The Federal hazardous materials transportation law is the basic statute pertaining to the transportation of hazardous materials (HazMat) in the united states.  This law requires the training of ALL hazmat employees.
The DOT defines hazardous material as any substance or material that could adversely affect the safety of the public and the environment. The Hazardous Materials Regulations (HMR) include training requirements in several sections of Title 49 code of Federal Regulations (CFR) as follows:
 

  • General - Part 173.1
  • Specific - Part 172.704
  • Modal (Air) Part - 175.20
  • Modal (Vessel) - Part 176.13
  • Modal (Highway) - 177.800 and 177.816


Each HazMat Employer Must


1. Train, test, and certify each employee within 90 days of employment or change in job function

2. Develop and retain records of current training of the past 3 years for each hazmat employee during the

    period of  employment and 90 days thereafter

3. Recurrent training is required at least once every three years since the actual date of training



Employees Required to have HazMat Training


1. Owner-operator of motor vehicle transporting the hazmat

2. Person who loads, unloads, or handles hazmat

3. Person who tests, reconditions, repairs, modifies, marks, or otherwise represents packaging as qualified

    for use in transportation of hazmat

4. Person who prepares hazmat for transportation

5. Person responsible for safety of transporting hazmat

6. Person who operates a vehicle used to transport hazmat

Fines for Violating HazMat Regulations

  • Each violation of any hazardous materials regulations, including training, may result in a civil penalty of

    up to $50,000

  • If the violation results in death, serious illness, severe injury to any person, or substantial destruction of

    property, penalty can  increase to a maximum of $100,000

  • A minimum of $450 civil penalty applies to violation relating to training

  • Criminal penalties may result in fine and imprisonment of up to 10 years if violation results in death or

     bodily injury.
